Terms of Use
The following conditions constitute the terms of use of the Moneygate website and also the general condition of engaging with us to provide advice on financial products.

Any advice or recommendation that we offer you will be based on your stated objectives and circumstances, taking into account any restrictions that you wish to place on the type of products you would be willing to consider. Unless confirmed in writing to the contrary, we will assume that you do not wish to place any restrictions on the advice we give you.

Full details of the products we may recommend to you including, for example, the minimum duration of the product, information on the right to cancel or whether no right to cancel arises, and any other early termination rights and penalties, will be covered in the relevant product disclosure information you will receive before conclusion of any contract.

YOUR PROTECTION
Circumstances can arise where we or one of our other customers may have some form of interest in business being transacted for you. If this happens or we become aware that our interests, or those of one of our other customers, conflict with your interests, we will write to you and obtain your consent before we carry out your instructions. At this time we will detail the steps we will take to ensure you receive fair treatment. In certain cases you can exercise a right to cancel, by withdrawing from the contract recommended to you. Please note that in most instances you will not be able to exercise a right to cancel a mortgage contract, unless the contract is concluded at a distance (i.e. no face to face advice), in which case you will have a 14 day cancellation period. Additionally, any contracts arranged with your explicit consent (normally referred to as execution only) do not provide cancellation rights.

If applicable, the cancellation period will begin on the day the contract is concluded or, if later, the day on which you receive the contractual terms and conditions. Instructions for exercising the right to cancel, if applicable, will be contained in the relevant product disclosure information which will be issued to you.

All Lenders Offer Documents will be forwarded to you as soon as practicable after we receive them. If there are a number of documents relating to a series of transactions we will normally hold each document until the series is complete and then forward them all to you at the same time.

DATA PROTECTION
• To provide you with full and appropriate financial advice we need to record and use information about your personal circumstances. This information will be held in our computer records in accordance with our registration under the Data Protection Act 1998. We will retain your information while you have a relationship with us and for any longer period that we are legally required to meet.
• If you give us information about another person we believe that you have their authority to consent to the processing of their information.
• We may use this information to obtain illustrations for you about the financial products we recommend and / or share it with third parties for account administration, debt tracing and collection, credit assessment, fraud prevention and to inform you of other products and services.
• We may also provide your data to the Financial Services Authority or the Banking Code Standards (or any other regulator or voluntary codes to which we are a member) for their use in monitoring our compliance with the relevant code.
• We will not disclose information about you to anyone else (other than our agents or other third parties performing any of the above activities on our behalf) unless we are required by law to do so.
• You are entitled to ask for a copy of any information held about you, subject to the payment of a fee applicable to that access, and you have the right to request that it be changed or deleted if it is incorrect.
• We may monitor and record telephone calls for training and security purposes.
Some services are provided to Moneygate by third parties, such as processing business or obtaining compliance or regulatory advice, which warrant the disclosure of more than just your basic contact details.

You agree that personal information held by Moneygate may be disclosed on a confidential basis and, in accordance with the Data Protection Act 1998, to any such third parties. You also agree that this information may be transferred electronically, e.g. via email, and you agree that we, or any such third party, may contact you in future by any means of communication which we consider appropriate at the time.

Privacy Policy
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998) and according to the Which? Web Trader Code of Practice. We collect information about you for 2 reasons: firstly, to process your application and second, to provide you with the best possible service. We will not e-mail you in the future unless you have given us your consent. We will give you the chance to refuse any marketing email from us or from another trader in the future. Only authorised personnel may access it. This is in accordance with our internal security policy and the law and the Which? Web Trader Code.

If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first. We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored by your browser. You can usually modify your browser to prevent this happening, however this may effect your browsing experience.
